Haldwani, Uttarakhand: For seven years, a cousin brother shamed the relationship by having a physical relationship with his 13-year-old minor sister. Not only that, but he threatened to murder his sister. Following his conviction for these crimes, the accused brother was sentenced to ten years in prison by Special Judge POCSO Act Nandan Singh Rana of the Nainital district.
While arguing for the maximum punishment for the accused, District Assistant Government Advocate Navin Chandra Joshi stated that the victim was only 13 years old in 2012. Then her cousin brother began physically abusing her. He had been harassing her ever since. However, due to localization and fear, the victim was previously unable to speak.
The accused stalked her again in 2018, when she enrolled in a college in Haldwani after reaching the age of majority.
In response, the victim demonstrated bravery by filing a FIR against her in Kotwali Haldwani. However, she bravely filed a FIR in 2018. As the victim was a minor at the time of the incident, action was taken under the POCSO Act.
In this case, government attorney Joshi had seven witnesses cross-examined in court. On conviction, Special Judge POCSO sentenced the youth to ten years in prison.
