Is Pakistan planning to hang jailed Indian national Kulbhushan Jadhav? The Pakistan government told the Supreme Court that the International Court of Justice (ICJ) ruling did not offer the right to appeal to a higher court. Pakistan’s Supreme Court was hearing a case in connection with convicted Pakistani citizens in the May 2023 riots for their alleged role in the incident following the arrest of former Pakistan PM Imran Khan.
Pakistan denied Jadhav the right to appeal
The lawyer of the Pakistani defence ministry was questioned if Kulbhushan Jadhav can approach the top court after being convicted by the military court, then why not a Pakistan citizen? The remarks came after the convicts approached the top court.
ICJ had ruled that Pakistan should review the death penalty
The Shehbaz Sharif government said Kulbhushan Jadhav was only granted consular access by the ICJ. The Pakistani government’s stance is against the ruling of the ICJ, and it is a breach of the Vienna Convention on consular relations. The ICJ had ruled that Pakistan should review the death penalty given to Indian national Kulbhushan Jadhav.
‘People who represented Pakistan at the ICJ were inept’
Abdul Basit, Former Pakistan’s envoy to India, said “Pakistan has handled Jadhav’s case in a wrong manner.” He said,” Pakistan lost the case at ICJ, but what was the need to go to the ICJ as Pakistan already stated that ICJ rulings do not apply to the nation.” He further added, “People who represented Pakistan at the ICJ were inept, and they lost the case .”
‘Mercy plea has been sent to Asim Munir‘
Basit said Jadhav’s mercy plea has been sent to Asim Munir, Chief of Army Staff of Pakistan, and no one knows what will happen until he makes a decision on the issue.
Jadhav was captured from Balochistan
Jadhav was captured from Balochistan by Pakistani security forces on March 3, 2016, after he allegedly entered the country from Iran as claimed by Islamabad.
India rejected Pakistan’s allegations about Jadhav’s involvement in spying and subversive activities and said he was kidnapped from the Iranian port of Chabahar where he was running a business.
