The Bombay High Court denied bail to the accused who allegedly raped an 80-year-old woman. The 27-year-old, who has been apprehended for 30 months, sought bail on the grounds of the woman’s passing, but Justice M.S. Karnik dismissed his request.
Considering the case’s details, Justice Karnik urged the trial court to expedite the case’s proceedings. He also emphasized that the accused should be promptly charged based on the recordings and statements from key witnesses. The accused, arrested on July 12, 2020, claimed in his bail application that he had been falsely implicated.
According to the application, the victim was 80 years old and suffered from various illnesses. Committing such a heinous act against a paralyzed victim is unimaginable. The accused, currently held in Taloja jail, contended that several individuals from the area falsely implicated him due to political rivalries. He argued that there was no substantial evidence against him, and the victim has since passed away.
The government lawyer, Rutuja Ambekar, vehemently opposed the accused’s bail application. He asserted that the accused visited the elderly woman’s house while he was intoxicated. The victim had detailed the accused’s misconduct in her statement. The lawyer emphasized that the victim’s death does not exonerate the accused. Whether the accused committed the crime or not will be determined during the trial based on the evidence.
The case was initiated by the elderly woman’s daughter-in-law, who filed a police complaint against the accused. The complaint stated that the daughter-in-law found her mother-in-law bleeding from the head when she returned from the kitchen, and the accused fled the scene. Furthermore, ten thousand rupees were missing from their house.
After hearing arguments from both sides, Justice Karnik rejected the bail application. The court stated that if there is no substantial progress in the trial after recording statements from key witnesses, the accused can reapply for bail in six months.
