Wikipedia has come into light for calling Atishi as the 8th Chief Minister of Delhi before her swearing-in. Wikipedia has written, “Atishi Singh or Atishi Marlena or mononymously Atishi is an Indian politician, belonging to the Aam Aadmi Party who is currently serving as the 8th Chief Minister of Delhi since 17 September 2024, after the resignation of Arvind Kejriwal”. Atishi was announced as new Delhi CM on 17 September following AAP National Convener Arvind Kejriwal’s resignation.

What Does The Rule Say?

As per the rules of The Constitution of India, in the states, the Chief Minister is appointed by the Governor who also appoints other ministers on the advice of the Chief Minister. The Council of Ministers is collectively responsible to legislative assembly of the State. However, in case of Delhi the rule differs.

According to Article 239AA of the Constitution of India which provides special provisions for the National Capital Territory of Delhi (NCTD), “The Chief Minister shall be appointed by the President and other Ministers shall be appointed by the President on the advice of the Chief Minister and the Ministers shall hold office during the pleasure of the President”.

In the case of Atishi, she has been unanimously decided as the leader of AAP legislature party and announced as Delhi CM by the AAP. She has been called Delhi CM designate in several articles, which focuses the attention to the word ‘designate’. Is ‘CM designate’ a right word to use for MLA who is yet to take oath as the CM?

In the Constitution there is no mention of word ‘designate’ or ‘CM designate’ for any MLA, there is no rule for appointment of CM designate in particular.

As per the rule, Lieutenant Governor administers the oath to CM of Delhi. And, only after swearing in and the official signature on the form, the appointed person assumes the office. So adhering to all these facts, Wikipedia’s mentioning of Atishi as the Delhi CM before her swearing in is debatable. Wikipedia is a free, online encyclopedia that anyone can edit and contribute to.

It is to be noted that Atishi has neither sworn in as the CM neither assumed the office. In such case, Wikipedia’s update on her designation is questionable.

Atishi will take oath as Chief of Minister of Delhi around 4:30 PM today.
