Parties in the INDIA Bloc in the Rajya Sabha are planning to submit a notice to initiate an impeachment motion against Allahabad High Court Judge Justice Shekhar Kumar Yadav. This move by the opposition follows a remark made by Justice Shekhar Kumar Yadav during an event, organized by VHP.
According to media reports, 36 MPs have signed the petitionwhich was initiated by Rajya Sabha MP Kapil Sibal.
According to media reports, the opposition may take this on Thursday, December 12 after getting some more signatures.
Currently, there are 85 MPs of INDIA bloc in the Rajya Sabha. The MPs who have already done signatures on the petition are Congress leader Digvijaya Singh, Jairam Ramesh, and Vivek Tankha. From AAP Sanjay Singh has signed the petition.
From Trinamool Congress Saket Gokhale & Sagrika Ghose did a signature on it and from RJD Manoj Jha did the signature on the petition. Javed Ali Khan from Samajwadi Party, John Brittas from CPI-M, and Sandosh Kumar from CPI have also done signatures for it.
As per the notice for the initiation of the impeachment process of the High Court Judge Justice Yadav is under Section 3 (1) (B) following the Judges Inquiry act.
According to this Judges (Inquiry) Act, 1968 the complaint against the Judge can be done via a resolution which should have the signature of at least 100 members of Lok Sabha or if it gets moved to Rajya Sabha then it needs to be signed by 50 Rajya Sabha MPs.
