Waqf Amendment Act 2025 Hearing Highlights: On May 22, a bench led by CJI BR Gavai and Justice AG Masih had reserved the interim order on the act after hearing the petitions for more than three days.

Waqf Amendment Act 2025 Hearing Highlights: The Supreme Court on Monday pronounced its Interim order on pleas to stay the provisions of the Waqf Amendment Act 2025. The Waqf (Amendment) Act was described as a ‘creeping acquisition’ of Muslim properties by several petitioners.

On May 22, a bench led by CJI BR Gavai and Justice AG Masih had reserved the interim order on the act after hearing the petitions for more than three days. While the Government upheld the act as a critical response to “rampant encroachment” of public and private properties, the filed petitions challenged the constitutionality of the sweeping reforms made to the Waqf law.

The requirement of somebody being a practising Muslim of five years has been stayed. The Waqf Council's composition where the number of non-Muslim members were vague has been limited to 4. Delhi: Advocate Anas Tanweer (petitioner who filed a plea challenging the Waqf Act) says, "The Supreme Court has first found that there is a prima facie case for stay on certain provisions. They have not stayed all the provisions, or the complete act, but certain provisions have been stayed, like the provision that said that you have to be a Muslim for five years, which has been stayed because there is no mechanism to determine whether someone has been a Muslim for five years or not... As far as non-Muslim members are concerned, the court has said that in the Waqf Board, it cannot be more than 3 and not more than 4 in Section 9, and on the registration, the court has apparently extended the time limit but has not stayed the provision..."

1. 3r- need 5 years as practising Islam stands failed until rules are formed, it would lead to arbitrary exercise of powers

2. 2(c) proviso- waqf property shall not be treated as waqf property

3. 3C- designed officer making challenge in revenue records permitting the collector to determine rights would be against separation of powers. Until finality, the rights of properties will not be affected. Until the title is not decided, neither waqf will be dispossesed of the property.

4. Shall not consist of more than 4 non-muslim members, and for State, not more than 3

5. Section 23- Ex-officio officer must be from Muslim community
