Telangana HC’s BIG Ruling: Driving a two-wheeler without a license is not a crime anymore. This remark was made by the Telangana High Court in the cheating case by a two-wheeler driver. A bench of Justice K Sujana ordered the cancellation of the FIR registered against a two-wheeler driver under section 420 of IPC. Section 420 of the IPC deals with cases of cheating and dishonesty.

In this case, the Supreme Court stated that driving a two-wheeler without a license is not a fraud in any way.

Telangana HC Stated It As Non-Punishable Offense

The Court stated “It is nowhere mentioned that the subject vehicle belongs to respondent number two or has been cheated to travel without a number plate. Therefore, the offense under Section 420 of the IPC does not apply. He also mentioned that Section 80(a) of the Act requires the display of the Registration number. And said this section does not provide any punishment. And it is nowhere said that driving a vehicle without a number plate is a punishable offense”.

Here’s The Whole Matter

In this case, a two-wheeler driver was stopped at a checkpoint near the chairman’s area. At that time the number plate was not found on that vehicle after which a case was resister against him under section 420 of IPC and section 80 (A) of the Motor Vehicle Act. Later the FIR was challenged at the High Court by the two-wheeler owner.
