Supreme Court Warns, Illegality In Election Commission’s SIR In Bihar Could Invalidate Process Nationwide

A bench of Justices Surya Kant and Joymalya Bagchi made it clear that the court cannot give a decision in parts on this issue, and its final decision will apply to SIR exercises conducted across the country, not just Bihar, as per media reports.

The Apex Court on Monday made an important observation that if any illegality is found in the process adopted by the Election Commission of India during the Special Intensive Revision (SIR) in Bihar, “the entire process can be declared invalid.”

According to reports, During the hearing, the court also said that it is assuming that the Election Commission, as a constitutional body, is “following the law and necessary rules.”

The Supreme Court has fixed October 7 as the date for final arguments on the validity of the ongoing SIR exercise in Bihar.

Earlier, on September 8, the Supreme Court had directed that “Aadhaar be accepted as the twelfth valid document for adding names to the voter list during the ongoing SIR in Bihar,” as election officials were not recognizing it despite an earlier order.

The bench of Justice Suryakant and Justice Bagchi rejected the objection of the Election Commission as to why Aadhaar should not be included in the list of accepted identity documents.
