Supreme Court Upholds Decision For UGC-NET Re-Test On August 21, Dismisses Plea

Supreme Court emphasized that two months had already elapsed since the initial ruling.

On Monday, the Supreme Court dismissed a petition that challenged the decision to hold a re-examination for the UGC-NET. The petitioners argued against the authorities’ decision to cancel the UGC-NET exam conducted on June 18 and reschedule it for August 21. They believed the cancellation was unfair, but the court decided that moving forward with the re-test was necessary.

The bench, led by Chief Justice DY Chandrachud and including Justices JB Pardiwala and Manoj Misra, highlighted that revisiting the petition would only create more uncertainty and disorder, especially since two months had elapsed since the initial ruling. Chief Justice Chandrachud emphasized the need for finality, stating, “We must move forward; the exams should take place on August 21 to provide clarity for students.” The bench also pointed out that although more than 9 lakh students are scheduled to take the exam, only 47 have opposed the decision.

The UGC-NET 2024 Exam took place on June 18, with more than 9 lakh candidates taking part. The next day, the Ministry of Education canceled the exam after the National Cyber Crime Threat Analytics Unit raised concerns about the exam’s integrity. The investigation was then handed over to the CBI for further action.

Court Clears Way for New Exam

The Union has also announced that details about the new exam will be shared soon. This decision came while the Supreme Court was already dealing with issues related to the NEET-UG 2024 Exams and claims of paper leaks.

Earlier, the Court had rejected a similar plea from a lawyer who challenged the cancellation of the UGC-NET exam. The Court said the lawyer had no standing in this matter and that it should be up to the affected students to take the issue to court.
