New Delhi: The Supreme Court has taken cognizance of whether the amount or property given to Muslim women by their husbands as Mehr is sufficient or not. A two-judge bench of the Supreme Court said that it will now look into whether the mercy given by the husband to the wife is sufficient.

During the hearing of the petition filed against Talaq-e-Hasan, the Supreme Court bench said that the woman cannot be left on her own terms after the divorce. For this reason, Islamic law should be followed along with its entire procedures. The Supreme Court is hearing a petition filed by a divorced woman, Benjri Heena.

Illegal triple talaq continues with the connivance of Qazis

Muslim woman Benazir Heena, seeking to declare Talaq-e-Hasan illegal, told the country’s Supreme Court that the practice of wrongful talaq in collusion with the Qazis is continuing. He said that even though the Central Government may have declared triple talaq illegal by making a law, but still many Muslim women are facing this curse. Heena said that Muslim men give their wives the decision of unilateral divorce, due to which the life of women is becoming hell. He said, ‘I am a journalist. Many people have supported me in presenting my case before the Supreme Court. I know 15-20 women from villages who are silently suffering atrocities. She is not even able to defend herself.

 

Supreme Court will look into Mehr amounts

Heena has made this claim before a bench of Supreme Court Justice Sanjay K Kaul and Justice AS Oka. On their submissions, the bench said, “It is for this reason that we are going to look into the larger issue of Talaq-e-Hasan.”

This bench of the Supreme Court said that after divorce, the amount given by the ex-husband as Mehr to the woman is very less, the court will consider it. According to Islamic law, at the time of marriage, the groom is obliged to give a certain amount or property to his bride as Mehr.

Senior advocate Shyam Divan, appearing in the Supreme Court on behalf of petitioner Benazir Heena, said that Meher’s amount is very less. He said that petitioner Heena’s husband should be made a party in this as she still wants her husband to take care of her and her child. Heena’s husband is also a lawyer. Heena said that she was divorced by her husband’s friend.
On this, the Supreme Court made Heena’s husband a party and sent a notice to him, to which he has to answer by October 11. Justice Kaul and Justice Oka said that there is a system of talaq-e-hasan in Islam, but it is mandatory to follow every procedure completely.
