The Supreme Court, led by Chief Justice DY Chandrachud, has refused to transfer the trial of a brutal rape and murder case involving an on-duty doctor at Kolkata’s RG Kar Medical College and Hospital out of West Bengal. CJI Chandrachud emphasized that the trial court judge at Sialdah has the authority to order further investigation if deemed necessary after examining evidence.
Counsel’s Plea for Transfer Denied
The transfer request was made by a counsel citing concerns over public faith in the West Bengal police and judiciary. However, the Supreme Court turned down the plea, with CJI Chandrachud stating that while the court has transferred cases in special circumstances, as in Manipur, this case did not warrant such action. The bench cautioned the counsel against making generalized statements on public sentiment, questioning the specifics of his representation.
CBI Investigation and Trial Updates
The Supreme Court reviewed the sixth status report from the Central Bureau of Investigation (CBI) on the ongoing probe but refrained from detailed commentary to avoid impacting the investigation. Charges against the primary accused, Sanjay Roy, were recently framed in a Kolkata trial court, with day-to-day hearings set to begin on November 11.

National Task Force Report Circulated for Healthcare Safety Protocol
The bench also directed that a report by the National Task Force (NTF) on safeguarding health professionals be shared with all states and union territories. The NTF was established by the Supreme Court to create a protocol following the case, aiming to enhance the safety of healthcare workers.
Court Orders for Infrastructure Improvements in Medical Colleges
Previously, the Supreme Court criticized the West Bengal government for delays in installing CCTVs, building toilets, and creating separate resting spaces in government medical colleges. The court set a deadline of October 15 for these improvements, which are part of ongoing oversight to address safety and infrastructure in healthcare facilities.

The Supreme Court’s intervention has played a key role in ending the doctor strike that emerged in response to this case, urging medical professionals to resume work without fear. The court continues to monitor the CBI investigation and case proceedings to ensure a thorough and fair trial.
