Modi Surname Case: Congress leader Rahul Gandhi’s petition in the Modi surname case will be heard in the Supreme Court on Friday. In fact, on July 7, the Gujarat High Court dismissed a petition seeking a stay on Rahul’s sentence. The Congress leader has challenged this decision of the High Court in the apex court. Senior advocate Abhishek Manu Singhvi will appear for Rahul Gandhi.
Justice BR Gavai and Prashant Kumar Mishra’s bench will hear Rahul Gandhi’s petition. Explain that Rahul Gandhi had filed a petition for urgent hearing of the case on July 15, which was accepted by the Supreme Court on July 18 and listed for hearing on July 21.
On March 23, the Surat court sentenced Rahul Gandhi to two years in the ‘Modi surname’ case. Rahul Gandhi appealed against the sentence in the Gujarat High Court, where the court upheld the decision of the Surat court. Now Rahul Gandhi has reached the Supreme Court demanding a stay on the sentence.
Aftermath of SC verdict
If Rahul Gandhi would not get relief in the case and loose the case in Supreme Court, then he will not be able to fight election till 2031. As per the rules, he will be barred from contesting any election after the completion of his for six years after completion of the two-year sentence awarded by the sessions court. The sentence of 2 years in 2025 and then six years suspension means Rahul Gandhi will not be able to contest elections till 2031
The Gujarat High Court refused to stay conviction of Rahul Gandhi in the case. Justice Hemant P. Prachhak observed that it was a serious matter affecting a large section of the society. The court needs to view it with seriousness and importance. Cleanliness in politics is the need of the hour. The representatives of the people should be persons of clear background.
