The Delhi High Court has directed the former Jammu and Kashmir Chief Minister Omar Abdullah to pay a sum of Rs 1.5 Lakh per month to his estranged wife – Payal Abdullah, as maintenance.
According to the High Court order, apart from this maintenance, former Jammu and Kashmir CM will also pay Rs 60,000 every month for his son’s education.
The court emphasized that awarding maintenance to a wife is a fundamental aspect of social justice.
It also highlighted the plight of children who often become unspoken victims and bear the brunt of such disputes. The court underlined that even if a wife possesses significant qualifications, she should not be denied her right to claim maintenance in accordance with her husband’s social and financial standing.

The court firmly asserted that husbands, who are physically capable and possess the means as per their income and social status, have a legal obligation to provide maintenance for their wives and children. This obligation should not be reduced to mere mathematical calculations, the trial court had stressed in 2018.
The wife had initially contested the trial court’s ruling and subsequently appealed to the Delhi High Court, where the awarded amount has now been increased. The Delhi High Court’s decision was rendered by Justice Subramonium Prasad.
