The bench, presided by Justice Mayank Kumar Jain, issued this directive in response to an Order 26 Rule 9 CPC plea filed by the deity (Bhagwan Shri Krishna Virajman) and seven others, represented by advocates Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey, and Devki Nandan in an ongoing original suit within the HC. It asserts that various indications substantiate the claim that the Mosque is, in fact, a Hindu temple, necessitating the appointment of a commission for investigation. Among the details presented in the application is the presence of a lotus-shaped pillar, a significant feature commonly found in Hindu temples. Additionally, it highlights an image of Sheshnaag, a revered Hindu deity known for protecting Lord Krishna on the night of his birth, within the premises. The plea also notes the existence of Hindu religious symbols and inscriptions at the base of the Mosque's pillar as evidence supporting the claim. Vishnu Shankar Jain, the lawyer for the Hindu side said, "Allahabad HC has allowed our application where we had demanded survey of (Shahi Idgah Masjid) by advocate commissioner. The modalities will be decided on December 18."
The Hindu side claims that Mughal Emperor Aurangzeb built the Idgah mosque by demolishing a temple on Lord Krishna's birthplace. In the High Court, 17 suits seek a declaration that the land where the Shahi Eidgah Mosque stands belongs to Lord Shri Krishna Virajman. They also request an order for the removal of the mosque.
