Allahabad High Court granted permission for a plea requesting the appointment of a court commissioner to examine the Idgah Mosque, a move with potential implications for the pending cases regarding the Mathura’s Krishna Janmabhoomi-Shahi Eidgah Mosque dispute.
The bench, presided by Justice Mayank Kumar Jain, issued this directive in response to an Order 26 Rule 9 CPC plea filed by the deity (Bhagwan Shri Krishna Virajman) and seven others, represented by advocates Hari Shankar Jain, Vishnu Shankar Jain, Prabhash Pandey, and Devki Nandan in an ongoing original suit within the HC.

The application, lodged as part of the pending case, contends that the birthplace of Lord Sri Krishna lies beneath the Mosque. It asserts that various indications substantiate the claim that the Mosque is, in fact, a Hindu temple, necessitating the appointment of a commission for investigation.
Among the details presented in the application is the presence of a lotus-shaped pillar, a significant feature commonly found in Hindu temples. Additionally, it highlights an image of Sheshnaag, a revered Hindu deity known for protecting Lord Krishna on the night of his birth, within the premises. The plea also notes the existence of Hindu religious symbols and inscriptions at the base of the Mosque’s pillar as evidence supporting the claim.
Vishnu Shankar Jain, the lawyer for the Hindu side said, “Allahabad HC has allowed our application where we had demanded survey of (Shahi Idgah Masjid) by advocate commissioner. The modalities will be decided on December 18.”
