Harming Women’s Mental Well-Being Will Be Considered Cruelty In The Criminal Law Bill

In the previous version of the bill, Section 85 provided for three-year jail for subjecting a woman to cruelty by her husband or in-laws

Two more sections to fight crime against women in the new criminal bill, Bharatiya Nyaya Sanhita, were added by the Indian Government.

The new bill is meant to replace the old Indian Penal Code (IPC). Three-year jail for subjecting a woman to cruelty by her husband or in-laws in Section 85 of the IPC, but in the new Section, 86 has been added to define cruelty, which includes harming a woman’s mental health and her physical well-being.

Revealing the identity of a sex assault survivor from court proceedings without permission will subject  to two years of imprisonment. The Bharatiya Nyaya Sanhita Bill, Bharatiya Nagarik Suraksha Sanhita and Bharatiya Sakshya Adhiniyam bills was introduced in Lok Sabha on August 11.

The three laws are introduced to replace the Code of Criminal Procedure Act (CRPC), 1898, the Indian Penal Code (IPC), 1860, and the Indian Evidence Act, 1872.

The Union government on December 12, withdrew and reintroduced the three new criminal law bills to make changes that were recommended by the Parliamentary Standing Committee on Home Affairs.

The three bills were introduced following a series of discussions with domain experts and various stakeholders.
