New Delhi: The Supreme Court on Wednesday set aside a Kerala High Court order upholding the Information and Broadcasting Ministry’s decision to cancel the license of news channel ‘Media One’, saying a free press is crucial for a strong democracy.
In its order, the Supreme Court also said that the process of ‘sealed cover’ violates the very principles of the nature of justice.
The top court emphasized the importance of a free press for the better functioning of society, saying that the critical views of the media cannot be termed as anti-establishment and such statements make it appear that the press is always supported by the government.
The apex court also rejected the submission regarding the alleged link of the shareholders to Jamaat-e-Islami Hind, saying that this should not be the right reason to restrict the rights of the channel.
Earlier, The apex court had stayed the central government’s decision to ban the Malayalam news channel and allowed it to resume its functioning.

The Kerala High Court on February 8, 2022, upheld the Ministry of Information and Broadcasting’s order to suspend the license of Media One citing security reasons.
Dismissing a petition challenging the order of the Ministry of Information and Broadcasting, the Kerala High Court made it clear that there is a very limited role for the court to intervene in matters of national security.
