In its significant judgement, a five-judge Constitution bench, on November 7, upheld constitutional validity of the 103rd amendment which introduces reservation for Economically Weaker Sections (EWS).

Chief Justice UU Lalit, Justices Dinesh Maheshwari, S Ravindra Bhat, Bela M Trivedi and JB Pardiwala heard a bunch of petitions challenging the Centre-introduced amendment.

It had delivered a 3:2 majority decision in favour of the 103rd Constitution Amendment.

The apex court ruled that the reservation on economic basis does not violate the essential features of the Constitution of India.

The 103rd amendment offers 10 per cent of reservation in admissions and government jobs that excluded the poor among the SC/ST/OBC categories. The bill introduced by the BJP-led central government was passed by both the houses in January, 2019.
