New Delhi: The Supreme Court on Monday issued a notice to the Union government on the plea of Delhi government challenging the constitutional validity of Ordinance by the Centre relating to control over bureaucrats.
The Arvind Kejriwal led Aam Aadmi Party government challenged the Modi government move to nullify the apex court verdict that allowed the elected government in the national capital to control the services related matters.
The Narendra Modi-led Centre on May 19 brought an ordinance to create a National Capital Civil Service Authority, negating the Supreme Court’s order.
The ordinance will deal with the power to recommend the transfer and posting of all Group A officers and officers of DANICS serving in Delhi.
Chief Minister of Delhi as ex officio Chairperson of the Authority will head the authority but his decision will not be supreme as other members such as Chief Secretary and Principal Home Secretary of NCT of Delhi will have an equal say.
All matters shall be decided by a majority of votes of the members present. In case of conflicts in view, the decision of the Lieutenant Governor shall be final.
“The central government, in consultation with the authority, shall determine the nature and the categories of officers and other employees required to assist the authority in the discharge of its functions and provide the authority with such officers and employees, as it may deem fit…,” read the ordinance.
