Yadav, in the PIL, argued that Kejriwal's remaining in office would not only hinder the legal process and impede justice but also risk destabilizing the state's constitutional framework. Yadav claimed that Kejriwal's imprisonment renders him unfit for fulfilling the criteria outlined in Article 163 and 164 of the Indian Constitution.
