Modi Surname Defamation Case: The Supreme Court on Tuesday agreed to hear Congress leader Rahul Gandhi’s plea on July 21 in Modi Surname Defamation Case, challenging the Surat High Court decision to stay his conviction in the case.
Congress leader Rahul Gandhi, who was convicted and sentenced to two years jail in a defamation case in March this year, has now moved Supreme Court to challenge the decision of Surat court.
A criminal defamation case was filed against Rahul Gandhi by Bjp Gujarat MLA Purnesh Modi, following Rahul’s remark over the surname Modi during the Karnataka election rally in 2019.
Earlier, the Gujarat High Court had dismissed Rahul Gandhi’s petition seeking a stay on his conviction in Defamation case.
This comes two days after a plea was filed following Surat High court refusal to stay the two-year jail term given by Magistrate court on the congress leader, leading disqualification from Lok Sabha MP.
The appeal was filed on Saturday morning and the date of hearing will be assigned on Tuesday. Rahul Gandhi reached apex court after his earlier pleas to the session court and high court were turned down his request.
Gandhi urged the top court to immediately stay his conviction to enable him to regain his MP status, arguing the conviction order would lead to throttling of free speech, free expression, free thought and free statement.
