Arvind Kejriwal SC Hearing: The Supreme Court has reserved its order on Delhi Chief Minister Arvind Kejriwal’s bail plea in the CBI corruption case erupted from the liquor excise policy case.
Earlier, the CBI had informed the Supreme Court that an arrest can be made without a warrant for proper investigation, particularly when there is a risk of evidence.
The Supreme Court will hear Delhi Chief Minister Arvind Kejriwal’s requests for bail and his challenge against his arrest by the CBI today. Justices Surya Kant and Ujjal Bhuyan are expected to oversee the case. Kejriwal was arrested by the CBI on June 26 and sought relief from the Supreme Court after the Delhi High Court upheld his arrest on August 5.
In a new charge sheet, the Central Bureau of Investigation (CBI) has claimed that the Aam Aadmi Party (AAP) gained from illegal funds created by the defunct excise policy. The agency said Delhi Chief Minister Arvind Kejriwal was involved in the criminal scheme related to the policy from the beginning.

CBI informed the Supreme Court that an arrest can be made without a warrant for the purpose of proper investigation, particularly when there is a risk of evidence being tampered with or witnesses being threatened. He emphasized that their case falls under these conditions.
Singhvi highlighted that all the co-accused in the Delhi excise case have been released. He pointed out that the trial court had observed the timing of the arrest as unusual and noted that the triple test had been fully satisfied. Singhvi also remarked on the irony that nearly all co-accused have been released, with only one exception.
In discussing the principles for granting bail, Kejriwal’s lawyer, Abhishek Singhvi, outlined key points to the Bar and Bench. He emphasized that “bail is the rule, jail is the exception” and noted that delays are not covered by Section 45 of the PMLA. Singhvi pointed out that multiple chargesheets have been filed and argued that prolonged incarceration should not be used as punishment.
He stated that the triple test for bail, which includes securing attendance at trial, is satisfied. Singhvi also highlighted that, given the multiple chargesheets and the impossibility of finishing the trial in the excise policy case, as seen in Manish Sisodia’s case, prolonged incarceration is unjustified.
Dr. Singhvi pointed out that the CBI waited two years to arrest Kejriwal after the ED filed the case in August 2022. Kejriwal was finally arrested on June 25 while he was already in judicial custody for the ED case. According to Singhvi, the only major event during this two-year period was a statement made by co-accused Magunta Reddy in January.
