Prayagraj: The Allahabad High Court on Monday directed to dispose of the civil case pending in the Mathura District Court regarding the land dispute of Shahi Idgah.
Justice Prakash Padia passed the order on the petition of the Sunni Central Waqf Board and others.
The court has disposed of the petition filed against the interim order and revision order. On the maintainability of the petition, the court said that the decision has already come in this matter. Therefore, no interference can be done in this matter.
The dispute came to light again, when advocate Ranjan Agnihotri and six others filed a plea in September 2020 in a lower court to remove the Shahi Idgah mosque from the complex adjoining Katra Keshav Dev Temple. Hindu side claims the spot as ‘Krishna Janmabhoomi.
According to Petitioners, the Edgar was built on a part of 13.37-acre land belonging to Shri Krishna Janmabhoomi Trust.
Hearing the objection of the Sunni Central Waqf Board, the court dismissed the civil suit on 30 Sep 20. Against which an appeal was filed on behalf of Lord Krishna Virajman. The opposite objected to the maintainability of the appeal. The court of District Judge Mathura, while accepting the application, had converted the appeal into a revision application.
Five questions were framed on the revision petition. On 19 May 22, the District Judge’s court set aside the order of the Civil Judge dated 30 September 2020 dismissing the suit and directed the subordinate court to pass the order as per the rules after hearing both sides. The legality of this order was challenged in these petitions.
