Lucknow: Uttar Pradesh Chief Minister Yogi Adityanath issued a new directive in the state to promote Ease of Doing Business. Under the new rule, preliminary investigation will be mandated before registering an FIR against any entrepreneur, businessman, educational institution, hospital, builder, hotel, restaurant etc.
Along with that, an order has been issued to the administration to ensure that the management level employees are not harassed in any way, reported IndiaTV.
Ease of doing business in UP
The Supreme Court had also issued an order in the matter in Lalita Kumari vs the state of Uttar Pradesh case where the police is asked to file an FIR if cognizable offences are disclosed. If the police personnel do not file the FIR then, they will attract a strict punishment.
The verdict makes it compulsory to carry out a preliminary investigation in the cases of civil nature, related to commercial dispute or accidental accident in establishment or institution.
Preliminary investigation should be done before registering FIR
Yogi Adityanath-led UP government claimed that the purpose behind doing this is to reduce the tendency of registering FIRs by giving criminal color to civil matters and disputes.
With the move, the government expects to reduce the number of FIRs that are fabricated for revenge or obtaining benefits from the businessman. This will make a favorable environment for investors in the state and the state will get more investment.
