After the rising complaints from the homebuyers, a firm stand has been taken by the Noida district magistrate Manish Verma, who has issued a strict warning to real estate developers who have completed the construction and have obtained the necessary certificates but are still delaying the registration of the flats.
During the review meeting recently, the DM has expressed concern about this critical matter where the rapidly increasing number of flat owners are still to receive their registry documents even after the construction has been done. While many homebuyers are still wholeheartedly waiting for years to get their homes delivered as soon as possible, they find themselves stuck between the legal and financial chaos due to the pending registration
The DM noted that developers must not withhold the legal registry of completed flats without valid reasons. He reminded builders that such actions are not only unethical but also violate legal provisions under the Indian Stamp Act and the Real Estate (Regulation and Development) Act (RERA). He warned that strict legal action would be initiated against any builder who fails to complete the registration process in a timely manner.
The DM has strictly prohibited the developers from withholding the registry without any proper excuse. He also aimed to jog the developers’ memory about how unethical and unlawful this is. This also violates legal provisions under the Indian Stamp Act and the Real Estate (Regulation and Development) Act (RERA). He has strictly stated that legal action would be taken against any builder who does not complete the registration process in time.
To expedite the process and provide relief to the affected buyers, the administration has already issued notices to 95 developers. These include 30 builders from Noida and 65 from greater Noida and Yamuna expressway region. The builders have been directed to complete all pending flat registrations where occupancy and completion certificates were issued on or before May 9, strictly by 31st May.
After all this, the district administration will be setting up special registry camps to speed up the process. Sub-registrars have been instructed to prioritise the resolution of registry-related issues raised by builders or flat owners. The DM has made sure that there will be zero tolerance for any delay, and no excuse will be entertained. This move will bring significant relief to thousands of homebuyers and will help to rebuild the trust.
